Louisiana Attorney General Jeff Landry said the measure prevents Joe Biden from “pursuing his unlawful overreach.”

The Republican official added that “the president will not impose medical measures on the American people without the checks and balances stipulated in the Constitution.”

A three-judge panel of appeals has granted temporary suspension to a group of companies, religious groups, defense organizations and several states that have filed a joint petition, arguing that the federal administration has overstepped its powers.

Among the states that have sued are Texas, Mississippi, South Carolina and Utah.

Serious legal problems

Although the ruling does not provide much detail, the court says in its summary order, which was signed by the deputy secretary, that the judges are blocking the regulation “because the petitions give reason to believe that there are serious legal and constitutional problems with the mandate.” He said the ruling was suspended “in Waiting for further action by this court.”

The Occupational Safety and Health Administration (OSHA) said companies that do not comply could face fines of approximately $14,000 for each violation.

Stronger rules will apply to another 17 million people who work in nursing homes, hospitals and other facilities they receive money from Medicare and Medicaid. These workers will not have the option to be tested and will need to be vaccinated.

Employees who test positive must be removed from the workplace.
